Please read this Agreement carefully. To participate in EuroClass activities, you must agree to all the terms of this Agreement.

This Waiver and Assumption of Risk, Release and Participant Obligation Agreement (hereinafter referred to as “Agreement”) is entered into between EuroClass and me, or my minor child (hereinafter referred to as “Participant”), to govern your participation in EuroClass High Performance Center activities.

I, on behalf of myself or my minor child’s guardian, if any, acknowledge and agree that in consideration of the participant being allowed to participate in any activities organized by EuroClass

Risk disclosure and acceptance

I HEREBY ACKNOWLEDGE AND AGREE THAT :

• The activities organized by EuroClass can be risky, some of which are inherent to the nature of the activity and the pandemic context (such as but not limited to COVID-19 contamination);
• As a result of the above risks and dangers, the participant may suffer serious personal injury or death;
• Some of these risks and hazards are foreseeable; others, however, are not;
• I nevertheless freely and voluntarily assume all of the aforementioned risks and dangers and, therefore, my preparations for and actual participation in EuroClass activities will be entirely at my own risk;
• I understand that EuroClass, its directors, officers, employees, promoters, independent contractors, sponsors, partners and agents will take the necessary safety precautions to conduct the activity, but assume no responsibility for any injury or property damage suffered by me in the course of my preparations to participate or my actual participation in EuroClass activities;
• I have read carefully and understood perfectly this Agreement and sign it freely and voluntarily;
• I fully understand that by signing this Agreement, I will never be able to sue or make a claim against EuroClass or the EuroClass High Performance Center;
• I fully understand that EuroClass will not permit me to participate in any EuroClass activity until I have accepted this Agreement, that it applies to all current or future EuroClass activities without exception, and that the terms of this Agreement have been explained to me by EuroClass or by one or more of its representatives, at my request;
• This Agreement is binding upon me, my heirs, executors, personal representatives and assigns;

Waiver of liability of EuroClass

I HEREBY RELEASE EuroClass and its directors, officers, employees, promoters, independent contractors, sponsors, partners and agents from any and all liability and WAIVE any and all remedies, proceedings, claims and causes of action of any nature whatsoever against EuroClass and its directors, officers, employees, independent contractors, for any personal injury, mental anguish, or property damage that I may suffer as a result of my preparations for or actual participation in EuroClass activities.

Obligation of the participant and/or his/her legal guardian

I HEREBY ACKNOWLEDGE AND AGREE THAT :

• I am physically able to participate in EuroClass activities and have no pre-existing conditions of any kind that would limit me from participating in physical activity and sports.
• I also recognize that I may be injured by another user’s loss of control and/or equipment.
• I also acknowledge that I may be contaminated with COVID-19 by attending EuroClass activities. I am responsible for not attending an activity if I (or my child) have flu-like symptoms or COVID-19, if I test positive or if I am in contact with someone who has COVID-19. I agree to report to EuroClass any symptoms or confirmed cases against myself or those around me.
• EuroClass is in no way responsible for loss, theft or damage to the personal property of the participant, visitor, instructor and facilitator.

A FINAL, COMPLETE AND DEFINITIVE RELEASE OF ALL LIABILITY AND WAIVER OF ANY RIGHT OF ACTION I have, will have, or may have in the future against EuroClass and or the EuroClass High Performance Center. and/or their directors, officers, employees, guides, representatives, publicists, sponsors, volunteers and other participants (who are collectively referred to as “the Beneficiaries”) from any and all liability for any loss, damage my minor child may suffer or incur, or his or her next of kin may suffer or incur, by reason of his or her participation, caused by any cause whatsoever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, BREACH OF ANY LEGAL PROVISION OR DUTY OF CARE BY THE BENEFICIARIES; and

A WAIVER AND AGREEMENT not to institute any proceedings against the Recipients for any loss, injury, expense or damage of any kind arising or resulting, directly or indirectly, from the participation of me or my minor child in the Recipients’ Action Sports activities; and

AN UNDERTAKING TO HOLD HARMLESS AND INDEMNIFY THE RECIPIENTS and each of them from any and all legal fees, court costs, liabilities, damages or costs of any kind which they may suffer or incur as a result of the institution of any legal proceedings or claims whatsoever against them, whether any such claims or proceedings are based on the negligence or gross negligence of the RECIPIENTS, or otherwise

UNDERSTANDING that this agreement shall be interpreted in accordance with the laws in force in the province of Quebec where the activities are held.

I have read this Release of Liability, Assumption of Risk and Indemnity Agreement, fully understand its terms, understand that I have waived substantial rights by signing it, and have signed it freely and voluntarily without any inducement, assurance or guarantee being given to me, and I intend that my acceptance and or signature, shall be construed as a full and unconditional release of all liability to the fullest extent permitted by law.
